General Terms and Conditions (GTC)
ALLINPULLS – Collectible Cards & Trading Cards
§1 Scope
These terms and conditions apply to all contracts concluded via the online shop.ALL-IN PULLSagreements are made between us and our customers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.
An entrepreneur is a natural or legal person or legally capable partnership who, when concluding a contract, acts in the exercise of their commercial or independent activity.
§2 Conclusion of Contract
(1) The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
(2) By submitting the order, the customer makes a binding offer in accordance with § 145 BGB.
(3) The automatic order confirmation by e-mail does not yet constitute acceptance of the offer.
(4) The purchase contract is concluded as soon as we confirm the order by means of a separate order confirmation in text form or dispatch the goods. The time of receipt by the customer is decisive.
(5) Working days shall be Monday to Friday, excluding public holidays.
§3 Prices and shipping costs
(1) All prices are final prices and include statutory VAT unless otherwise stated.
(2) Shipping costs are added to the purchase price. The amount of the shipping costs will be displayed transparently during the ordering process.
§4 Delivery and Transfer of Risk
(1) Delivery shall be made to the delivery address specified by the customer.
(2) In the case of consumers, the risk of accidental loss or accidental damage to the goods passes to the customer only upon delivery.
(3) In the case of entrepreneurs, the risk passes to the customer upon handover of the goods to the shipping company.
§5 Retention of Title
The delivered goods remain our property until the purchase price has been paid in full.
§6 Payment methods
Only the payment methods offered during the order process are available. There is no entitlement to a specific payment method.
§7 Right of withdrawal / Exclusion for opened products
(1) Sealed products (boosters, displays, boxes)
Atsealed trading card products(e.g. booster packs, displays, boxes) consistsNo right of withdrawal or exchange, if the seal has been removed or damaged after delivery.
➡️ This is especially true since, once opened, it can no longer be ruled out that cards have been exchanged, removed, or manipulated.
(2) Opened goods
Opened, unsealed, or used products are excluded from exchange and return., provided there is no legal defect.
§8 Individual tickets – Condition assessment & special features
(1) We sell individual tickets to the best of our knowledge and belief and evaluate them carefully.
(2) The condition descriptions (e.g. Near Mint, Excellent, Good etc.) representsubjective assessmentsThey are shown and may vary slightly.
(3)Production- or manufacturer-related characteristics(e.g. centering, minimal print lines, edge or surface features) representno shortageprovided they are commercially available.
(4) Illustrations are for orientation purposes.Slight variations in color or detail may occur.are technically possible.
(5) An exchange or return ofSingle ticketsis excluded unless there is a legally relevant defect.
§9 Liability for Defects
The statutory warranty rights apply. Normal, production-related deviations do not constitute a defect.
§10 Consumer Information
(1) Input errors can be identified and corrected using the appropriate correction functions before the order is submitted.
(2) The language of the contract is German.
(3) The essential characteristics of the goods are evident from the respective product description.
(4) The contract text will be sent to the customer by e-mail after conclusion of the contract.
§11 Dispute Resolution
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§12 Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Mandatory consumer protection regulations of the state of habitual residence remain unaffected for consumers.
§13 Final Provisions
Should individual provisions of these terms and conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
